2.2 Department of IT & Communication (DoIT&C), Government of Rajasthan (GoR) is the state nodal agency for executing IT / e-governance projects in the State of Rajasthan.In pursuance to Government of Rajasthan Policy for promoting the use of technology in Governance and citizen welfare activates, DOIT& C has developed e-Bazaar.rajasthan.gov.in an online store as the single e-commerce based solution for inventorying the store and selling of items, through RISL.http://e-Bazaar.rajasthan.gov.in
2.3 The Store has been developed with the objective to provide a single window access for e-Commerce activities for various products by Government of Rajasthan for citizens and other Stakeholders and available at http://e-Bazaar.rajasthan.gov.in
2.4 RajCOMP Info Services Ltd. (formerly RajCOMP) is a fully owned Government of Rajasthan Company; it is a leading consulting organization in the field of Information Technology. RajCOMP Info Services Ltd. (RISL) operates under the aegis of Government of Rajasthan. RISL is designated State Designated Agency(SDA) for implementation of NeGP Components i.e. State Data Centre (SDC), State Wide Area Network (SWAN), Common Service Centre (CSC), State Service Delivery and other State’s Mission Mode Projects (MMPs).
2.5 Logistic partner (s) are the agencies associated with e-Bazaar.rajasthan.gov.in to provide logistic services to pick-up and deliver items/ goods available for sale by associated department/ purchased by consumer/ customer from the seller’s departmental/ any specified location to desired destination.
3.1. through coordinating agencies will deliver the items/ goods to seller’s/ departmental/ E-Bazaar collection center or godowns for further distribution to consumer.
3.2. RISL will integrate with platform for delivery of aforementioned service and RISL will make the best efforts to get the technology to work effectively for the distribution of various services of through logistic partner (s) network. The two parties shall work together to make the technology work efficiently for smooth service provisioning.
3.3. All stakeholders of e-Bazaar shall be responsible and accountable to provide best in class services to end customer/ consumer of e-Bazaar through collaborative efforts.
3.4. Both parties ensure all tasks shall be performed by each of them efficiently and effectively as mentioned in this document under roles and responsibility clause respectively.
3.5. If any issue/ task is not addressed/ defined in this document, the both parties shall address/ perform the issue/ task respectively in coordinated manner through mutually agreed decision considering strategic objective of e-Bazaar, expertise of the parties and customer/ consumer benefits.
3.6. This Agreement will not restrict the rights of any or all the parties to request for changes in the relationship during the tenure of this Agreement, which is agreeable to all the parties.
3.7. RISL and , both, agree to modify the terms & conditions of this Agreement on mutually agreed terms & conditions.
3.8.1 shall provide requisite details of each and every item/ good which will be displayed at e-Bazaar for sell in the format prepared by RISL to technical team of RISL.
3.8.2 RISL shall display the items/ goods provided by at e-Bazaar portal.
3.8.3 Customer may place an order through the portal and make payment through e-mitra payment gateway.
3.8.4 Once an order is placed by a customer for available item/ good, the shall ensure execution of the order and coordinate with respective collection center/ godown in-charge.
3.8.5 Logistic partner shall pick up the ordered items/ goods and deliver within the stipulated time mentioned in its agreement.
3.8.6 An order shall be remain active till the successful delivery of the ordered items/ goods to the customer/ consumer and it will be closed automatically after acknowledgement received by customer/ consumer.
3.8.7 The customer/ consumer may cancel an order within the stipulated timelines defined in the SOPs/ Terms & Conditions of e-Bazaar which will be created through mutually agreed manner by both parties considering items/goods specifications, involved efforts and cost of all respective stakeholders of e-Bazaar in execution of the order.
3.8.8 All respective stakeholders are responsible and accountable to deliver the ordered items/ goods in good condition as per specifications and agreed terms and conditions mentioned in their respective agreements/contracts.
3.8.9 Respective payment to all stakeholders shall be done on monthly basis, after reconciliation of all transactions made through e-Bazaar concerning applicable penalties/ LDs.
3.8.10 Logistic partner will be responsible for returning damaged goods to collection points/go down of .
4.1.1 Coordinate, facilitate and spread awareness for the services of
4.1.2 RISL shall establish adequate communication plan to keep updated on latest development or enhancement of functionality of e-Bazaar.
4.1.3 RISL shall prepare and provide requisite templates/ guidelines/ SOPs related to e-Bazaar. Updates and changes in the documents shall be intimated and provided to immediately.
4.1.4 Online reports containing details of fields (jointly decided by both parties) will be available to on unified dashboard of e-Bazaar portal designed for the . RISL will provide user id and password to to take report.
4.1.5 To provide all the required Technical support, if any, to and its implementing agency for smooth integration/ running of the system.
4.1.6 To nominate a nodal officer for the purpose of interaction with .
4.1.7 At the end of a month; RISL and nominated Nodal Officer of shall jointly reconcile the accounts and submit a jointly verified statement based on transactions being made through e-Bazaar.
4.1.8 RISL will timely notify about any change in the agreed service charges from the date of signing of this Agreement.
4.1.9 RISL shall provide training to ‘s nominated officers (Max. 10 Officers) through Training of Trainer method on utilization of e-Bazaar functionalities based on their roles defined in the portal as per requirement.
In case of enhancement/ change in e-Bazaar functionalities/ on special demand of , refresher trainings shall be provided if required.
4.2.1 shall follow and ensure all SOPs/ Guidelines provided by E-Bazaar to utilize e-Bazaar platform.
4.2.2 shall clearly provide details of Items/ Goods which will be displayed for sell at the portal in the specified templates.
4.2.3 shall ensure quality and quantity of the items/ goods as per specifications provided in the template of Item List.
4.2.4 shall provide list of godowns/ collection centres/ coordinating agencies of the seller with details of available items/ goods as per the template of Seller’s Godowns/ Collection Centre/ coordinating agencies.
4.2.5 shall provide requisite information and support through ’s coordinating agency about any Item/ good/ godown/ coordinating agencies etc. to RISL technical team and other stakeholders of the e-Bazaar as and when required.
4.2.6 or their coordinating agencies will deliver the items to collection centres or godown of other stakeholders for further distribution to consumer.
4.2.7 or their coordinating agencies shall be responsible for inspection and packaging of all items/goods supplied/ delivered at collection centres or godown of other stakeholders for further distribution or the items/goods will be supplied to the customer/ consumer from its own godowns/ collection centres.
4.2.8 shall be responsible for packaging of all items/goods supplied/ delivered at collection centres or godown of other stakeholders for further distribution. It must be ensured that all items shall be sealed and dually packed properly by the specified material according to guidelines of logistic partner.
4.2.9 In case packaging is done by the logistics partner, the actual cost of packaging as per the logistic partner will be charged to seller.
4.2.10 should mentioned detail of Items/ Goods i.e. Item Name/Model/ Category/ Quantity/ Specification on the packaging as per agreed template so that distribution from other stakeholder’s godowns/ collection centre will be initiated without opening of the packaging to the customer/ consumer.
4.2.11 shall support and provide requisite information to E-Bazaar in execution/ implementation of e-Bazaar portal concerning its area of scope.
4.2.12 will nominate a nodal officer for the purpose of interaction with E-Bazaar.
4.2.13 At the end of a month; RISL and nominated Nodal Officer of shall jointly reconcile the accounts and submit a jointly verified statement based on transactions being made through e-Bazaar.
4.2.14 will submit to E-Bazaar the details of various fees/rates/costs to be charged from and also timely notify to E-Bazaar about any change in the fee/rate/cost from the date of signing of this Agreement.
4.2.15 or their coordinating agencies shall ensure that their godowns/ collection centre execute any order within the stipulated timelines mentioned in the SOPs/guidelines of e-Bazaar.
4.2.16 shall ensure the publicity of the services of e-Bazaar portal on its website
4.2.17 In case of Return/Refund cases, and its coordinating agencies shall be responsible for bearing any charges [For e.g. Shipping Charges] that occur due to manufacturing defect.
4.2.18 In case of Return/Refund cases, Logistic Partner shall be responsible for bearing any charges[For e.g. Shipping Charges] that occur due to damage during transition/shipping the product to Citizen/Buyer’s address
4.2.19 is responsible for logistics charges and have an option of either borne the logistic charges itself (free delivery) or pass the logistic charges to citizen (citizen will be charged above the selling price). And generated invoice will be inclusive of logistic and other charges.
4.2.20 All the logistics (delivery/return/replacement) will be handled by seller (LSP) or its coordinating agencies along with applicable guarantee/ warrantee. (applicable in self shipment)
4.2.21 If the logistics will be handled by the seller or its coordinating agencies, charges/penalties may be applicable to maintain the delivery timelines based on defined SLA at point No: 5 in agreement with logistics partner of e-Bazaar:-
|Delivery to citizen address (within Rajasthan)
|Delivered to citizen within 7 days (within Rajasthan) / 10 days (out of Rajasthan) from date of successful order (should be marked delivered in e-Bazaar system)
1 % of selling price till 7 days after estimated delivery time per day.
2 % of selling price from 8th day after estimated delivery time to till delivered per day.
After 14 day if order is not marked delivery on e-bazaar system, order may be cancelled without prior information to seller.

|Order should be delivered within 3 days after issue raised and confirmed.
10 % of selling price if order is delivered within 3 days.
If not delivered within 3 days, order cancelled and Product listing is blocked.

The SLA and penalties are decide on initial level to start with LSPs working with RISL as e-Bazaar seller. The same may be revised based on review of quality of services provided by seller with self-logistics model.
will pay fee for each successful transaction on e-Bazaar portal and the charges will be 2.5% of the selling price of product (GST extra). And will also pay the cost of logistics charges if any applicable for the delivery of the order (GST extra).
RISL shall not be held responsible for any claim/ damage awarded for the deficiency in service attributable to any act of omission/ fraud/ theft/ missing etc. committed by the staff of godowns/collection centres/ logistic partners of any stakeholder of e-Bazaar either wilfully or by negligence or whatsoever.
If any dispute arises out of this Agreement with regard to the interpretation, meaning, terms and condition, the matter shall be referred to by RISL and to the Secretary, IT&C, Govt. of Rajasthan and whose decision shall be final and binding upon both the parties.
Both, RISL & , shall be responsible for maintaining absolute secrecy and security with respect to the e-Bazaar application as well as the consumer.
